An overview of Jersey's Trusts Law amendments


The enactment of the Trusts Law in 1984 brought welcome certainty and confidence to trust law in Jersey. The Law has been amended four times, in 1989, 1991, 1996 and 2006. Amongst other things those amendments have permitted non-charitable purpose trusts, clarified the effectiveness of settlor reserved powers and introduced so called "firewall" provisions in relation to the pre-eminence of Jersey law in various key areas. The most recent and fifth set of amendments makes a number of further improvements to the Trusts Law.

In this briefing, Mourant Ozannes summarises six amendments to the Trusts (Jersey) Law 1984 made by the No5 Amendment which came into force on 2 November 2012.
