Michael Jordan vs Qiaodan Sports: Playing to the buzzer

Overview

On 8 December 2016, the Supreme People's Court ("SPC") handed down its judgments in the long-running and high-profile trade mark disputes between retired US basketball star Michael Jordan and the domestic sportswear retailer, Qiaodan Sports.

Michael Jordan had lost at both the Trade Mark Review and Adjudication Board (the "TRAB") and two subsequent administration appeals. The SPC decision, although not a complete victory for Michael Jordan, is far more positive for trade mark proprietors looking at China as a jurisdiction to do business.
